Definition and organisation of IPR Prague activities and data handling guidelines
Founding Charter of the Prague Institute of Planning and Development – issued on the basis of Prague City Assembly Resolution No. 32/2 of 7 November 2013, it defines the main activities of IPR Prague. A detailed specification of its tasks is set out in Article VI thereof.
Definition of Requirements for the Digital Map of Public Administration of Prague – issued on the basis of Prague City Assembly Resolution No. 33/49 of 12 December 2013, it defines the required content and parameters of the basic digital map for the agenda and activities of public administrative bodies in Prague.
Activities related to urban planning and building procedures
Building Act No. 183/2006 Coll. – defines the basic tasks of spatial planning authorities to acquire and update land-use planning documents (ÚAP) and documentation. In terms of geographic data management, it is particularly important to establish an obligation by the owners of technical and transport infrastructure to provide data to the ÚAP, and the ability to use this data to manage and maintain municipal technical maps. In managing municipal technical maps, it is also essential to incorporate the obligation of developers to submit to the building authority documentation for the execution of construction in defined cases.
Decree No. 500/2006 Coll., on planning analytical materials, urban planning documentation and the method of recording urban planning activity – this is an implementing regulation to Act No. 183/2006 Coll. and specifies the requirements of such documentation in more detail. In terms of geodata management, Annexes A and B are particularly relevant and define a mandatory list of phenomena in planning analytical materials.
Standards relating to the management of municipal technical maps and the provision of data from the Land and Property Register of the Czech Republic:
ČÚZK Decree No.233/2010 on the basic content of municipal technical maps – provides a basic list of the contents of municipal technical maps in terms of the structure of topographical elements, elevation, a description of the technical map and metadata on features of the technical map.
Decree No.358/2013 on the provision of data from the Land and Property Register of the Czech Republic – defines the conditions for the provision of data from the Land and Property Register, form of provision and payment. Under a contract with the Czech Office for Surveying, Mapping and Cadastre (ČÚZK), IPR Prague is the data provider and its activities are governed by this Decree.
Directive 2007/2/EC of the European Parliament and of the Council establishing an Infrastructure for Spatial Information in the European Community (INSPIRE) – defines the requirements for access to spatial data and its administration in order to maximise its use by public authorities in EU member states. It sets out the obligations for member states and their public administrations regarding data and metadata standardisation and its accessibility through web services. The INSPIRE Directive was transposed into Czech law by an amendment of Act No. 123/1998 Coll. under Act No. 380/2009 Coll.
Act No.380/2009 Coll.,on the right to information about the environment – concerns the establishment of the National INSPIRE geoportal and lists entities required to provide spatial data and metadata according to the requirements stipulated in the INSPIRE Directive, which defines thematic data areas covered by the Directive, specifies services, metadata, data access rules and other conditions. Technical standards for detailed INSPIRE specifications are transposed into Czech law as they are released by the European Commission. Implementation rules for metadata, data specifications, network services, data sharing, monitoring and reporting are of particular relevance.
Prague City Hall/IPR Prague is the legally mandated organisation in the context of INSPIRE in relation to selected thematic data sets, especially in relation to Annex III of the INSPIRE Directive.
General legislation governing the Geographic Information System
Act No. 106/1999 Coll., on free access to information – establishes the fundamental obligation of public authorities to provide information relating to their activities.
Government Regulation No.425/2016 Coll., on the list of information published as open data.
Act No. 365/2000 Coll., on public administration information systems – defines the rights and obligations related to creating, using, operating and developing public administration information systems.
Act No. 111/2009 Coll., on basic registers – defines the content of basic registers and the territorial identification information system and specifies the rights and obligations related to their creation, use and operation, and establishes the Administration of Basic Registers. Basic registers are defined as the Population Register, Register of Persons, Register of Territorial Identification and Register of Rights and Obligations.
Act No. 110/2019 Coll., on processing personal data – lays down the rights and obligations relating to personal data processing.
